2014-05-28 Reminders about Fee Increases, Bench-Bar Brown Bag, and Proposed Local Rules, Forms and GPOs

Notice from the Clerk of the Court, U.S. Bankruptcy Court, District of Colorado:

(1)  Just a friendly reminder that the new fees will be effective on Sunday, 6/1/2014. There may be a twenty-four hour lag in putting the fee increase into CM/ECF, however, we will issue deficiencies for any shortages in fees for those cases filed on Sunday, June 1st. The new fees are:
  • Fee for filing an adversary complaint increased to $350.00
  • Administrative fees increased as follows:
    • for the filling of a new petition under Chapters 7, 12 or 13 to $75.00
    • for the filing of a new petition under Chapters 9, 11 or 15 to $550.00
    • for the filing of a motion to deconsolidate/split a joint case under Chapters 7, 12 or 13 to $75.00
    • for the filing of a motion to deconsolidate/split a joint case under Chapters 9, 11 or 15 to $550.00
  • As a result of the administrative fee increase, fees for filing a new bankruptcy petition increased as follows:
    • Chapter 7 filing fee increases to $335.00 
    • Chapter 9 filing fee increases to $1,717.00
    • Chapter 11 filing fee increases to $1,717.00
    • Chapter 12 filing fee increases to $275.00
    • Chapter 13 filing fee increases to $310.00
    • Chapter 15 filing fee increases to $1,717.00
(2)  Please remember to attend the Bench/Bar brown bag on June 4th in room 183 of the U.S. Custom House. The room is located on the 1st floor at the end of the hallway down from where the meetings of creditors were held prior to construction (interior location is the corner of 20th St. and Stout), unless you are handicapped, you still need to come in through the main entrance on 19th St. (For attorneys outside of the Denver/Metro area desiring to participate by telephone, please contact me PRIOR to Wednesday to obtain our new call in information.) 

(3)  Finally, is a reminder on the deadline of June 19, 2014, for comments on the proposed local rule and form modifications and the new General Procedure Orders. Please visit the homepage on our website to view clean and redline versions. The majority of the rules address revisions related to counsel and payment to account for the adoption of Section IV – Attorney Rules, D.C.COLO.LAttyR by the United States District Court and two are directed to addressing the issue of the claims in Chapter 13. The General Procedure Orders address Installment Payments and Filing Fee Waivers. Following review and consideration of the comments, the anticipated effective date will be July 1, 2014. Pursuant to Fed.R.Bankr.P. 9029, this is being sent out for Notice and comments. The Court welcomes comments from court users, members of the Bar and the public at large.
